Mandatory Death Penalty Charge

Acquittal Following Rejection of Agent Provocateur Allegation

In September 2013, the Kuala Lumpur High Court acquitted Australian national Dominic Bird of drug trafficking charges carrying the mandatory death penalty. Mr Bird had been arrested in March 2012 following an undercover police operation in Kuala Lumpur.

The defence focused on the reliability of the prosecution's evidence and the credibility of key witnesses. The High Court held that the prosecution had failed to prove its case beyond reasonable doubt. The acquittal was later upheld, and Mr Bird was permitted to return to Australia.
